However it has not been thought about liability for potential hazards of these damages. Leading nuclear countries, in addition to developing a civil liability law on nuclear activities, have become parties to the relevant conventions. These conventions including the Vienna Convention are based on the basic principles governing civil responsibility for nuclear events. The benefits of membership in the convention are: channeling of liability to operator, limitation of liability in amount and time, operator’s absolute liability and … that they contribute to the development of the nuclear industry. In some cases, the compensation is referred to domestic la which despite its benefits for avoiding inconsistencies in the legal system of countries in solving specific problems, In our country, because of the lack of specific civil nuclear legislation, it is actually a challenge. Therefore legislation in this field is more necessary.  }, keywords = {Nuclear Damage,1997 Vienna Convention,Civil Liability,Iranian Legal System}, title_fa = {فرصت‌ها و چالش‌های الحاق جمهوری اسلامی ایران به کنوانسیون وین راجع به مسئولیت مدنی در قبال خسارات هسته‌ای}, abstract_fa = {جمهوری اسلامی ایران امروزه به‌ عنوان یک کشور هسته‌ای شناخته می‌شود و هرروز به فعالیت‌های هسته‌ای آن افزوده می‌شود. با این‌حال در خصوص مسئولیت‌های ناشی از مخاطرات احتمالی، چاره‌اندیشی نشده است. از اقداماتی که کشورهای پیشتاز هسته‌ای، علاوه بر تدوین قانون خاص مسئولیت مدنی برای این‌گونه فعالیت‌ها داشته‌اند، عضویت در کنوانسیون‌های مربوطه است. این کنوانسیون‌ها از جمله کنوانسیون وین، با رعایت اصول اساسی حاکم بر مسئولیت مدنی ناشی از مخاطرات هسته‌ای تنظیم شده است. از جمله مزایای عضویت در کنوانسیون مذکور می‌توان به تعیین متصدی به‌عنوان مسئول و محدود کردن مسئولیت وی در زمان، میزان و مطلق بودن مسئولیت وی و مانند آن که همگی به توسعهی صنعت هسته‌ای کمک می‌کنند اشاره کرد. در بعضی موارد، جبران خسارت، به حقوق داخلی ارجاع شده است که با وجود امتیازاتی که به منظور پرهیز از ناهماهنگی در نظام حقوقی کشورها در حل مسائل خاص دارد، در کشور ما که قانون خاص در این زمینه نداریم در واقع چالش محسوب می‌شود. بنابراین ضرورت تدوین قانون خاص در حقوق ایران، که متناسب با مخاطرات احتمالی باشد بیش ‌از پیش نمایان می‌سازد.}, keywords_fa = {خسارات هسته‌ای,کنوانسیون 1997 وین,مسئولیت مدنی,نظام حقوقی ایران}, url = {https://jonsat.nstri.ir/article_212.html}, eprint = {https://jonsat.nstri.ir/article_212_676dce2af2a0bc304058e029275d8c5e.pdf} }
