چکیده
به حرکت درآوردن وسایل نقلیه با استفاده از انرژی هستهای (پیشران هستهای) ازجمله کاربردهای مهم این انرژی محسوب میشود. در حال حاضر فقط کشورهای دارنده سلاح هستهای پیشرانهای هستهای را در اختیار داشته و از آنها بهرهبرداری میکنند. برخی از کشورهای غیردارنده سلاح هستهای، از جمله ایران نیز در تلاش برای دستیابی به آن میباشند. اینکه آیا قواعد بینالمللی اجازه بهرهمندی از پیشرانهای هستهای را به کشورهای غیر دارنده سلاح هستهای اعطا میکند پرسشی است که مقاله حاضر به روش توصیفی- تحلیلی به بررسی و ارزیابی آن پرداخته است. یافتههای این پژوهش حاکی از آن است که هرچند که بر اساس قواعد و مقررات بینالمللی جاری و با رعایت شرایطی این کشورها مجاز به دستیابی به پیشرانهای هستهای یا بهرهبرداری از آنها میباشند، اما درعینحال نظام حقوقی برخورداری کشورهای غیر دارنده سلاح هستهای از پیشرانهای هستهای متضمن نارساییها، ابهامات و اشکالاتی میباشد که میتواند بهرهمندی این کشورها از این پیشرانها را در عمل با محدودیتها و چالشهایی مواجه نماید.

چکیده [English]
Propelling transport means using nuclear energy (nuclear propulsion) is a significant application of this energy. Currently, only nuclear-weapon states possess and operate nuclear propulsion systems. However, some non-nuclear-weapon states are also attempting to acquire this technology. This article investigates and evaluates whether international rules permit non-nuclear-weapon states to operate nuclear propulsion systems using a descriptive-analytical approach. The findings indicate that, under current international rules and subject to certain requirements, non-nuclear-weapon states are allowed to obtain or operate nuclear propulsion systems. Nevertheless, the legal framework governing nuclear propulsion in non-nuclear-weapon states is marked by inadequacies, ambiguities, and challenges that may impose practical restrictions on their ability to acquire and operate such technology.
